Chutkan bent the rules of criminal procedure to let Smith dump all the evidence and grand jury testimony he gathered four weeks before the election. This allows Smith to try his case in the court of public opinion where the voters only hear Smith’s version of events packaged in the most damning form possible and without any pushback from Trump. Trump is denied his constitutional rights to cross-examine witnesses, make motions to exclude evidence and testimony, and enter evidence of his own to counteract Smith’s claims.
