I think this was just a very unfortunate accident. I watched a video on YouTube last night that showed what one inspector believed happened. The tower twice was told by the helo that the helo had visual control of the aircraft and it was his job to use direct site to avoid hitting the plane. There were apparently 3 planes coming in for landings pretty close together, which was pretty normal for this airport at this time of night and this person believes the helo had visual with the 2nd airplane and never actually saw the aircraft he collided with. From the video I saw it appeared to me the helo and the plane were traveling basically in the same general direction but the radar viseo he showed the were actually traveling in opposite directions.
