From the Washington Post: The Supreme Court on Wednesday upheld the Biden administration’s regulation of ghost guns, the largely untraceable firearms that had been used in a growing number of crimes over the past decade and alarmed law enforcement agencies.
In a 7-2 ruling written by Justice Neil M. Gorsuch, the justices allowed 2022 rules by the Bureau of Alcohol, Tobacco, Firearms and Explosives that require serial numbers, sales receipts and background checks for the weapons, which are typically purchased in kits online and assembled at home. Justices Samuel A. Alito Jr. and Clarence Thomas dissented in separate opinions.
The decision — supported by justices on both sides of the court’s partisan divide — could be considered a departure for the Supreme Court’s conservative majority, which has been skeptical of gun regulation in recent terms. The justices issued a landmark decision in 2022 that made it easier to challenge restrictions on firearms.
In the ghost gun case, the justices ruled that the weapons, which are sold partially assembled, count as firearms under the 1968 Gun Control Act, which means they can be regulated in the same way as other commercially available guns. The case, which was one of the most significant of the current term, did not implicate the right to bear arms that is enshrined in the Second Amendment.

Democrats are celebrating the victory.
Pennsylvania Gov. Josh Shapiro, a Democrat, cheered the ruling, writing, “As Attorney General, I went to court and worked with law enforcement to take these dangerous, untraceable ghost guns off our streets and out of the hands of criminals. Today’s Supreme Court ruling is a victory for common sense policies that help police do their jobs and make our communities safer. My Administration will continue to work with law enforcement at all levels to keep ghost guns out of the hands of those who shouldn’t have them.”

Gun control activist David Hogg, now a vice chair of the DNC, also celebrated, “In the past 24 hours two very good things have happened- we won a state house race in a PA district that Trump won by over 15% AND SCOTUS just upheld a rule created by Biden to stop the proliferation of ghost guns.”

Senate Minority Leader Chuck Schumer wrote, “Ghost guns have been a terror on our streets. For years, I have been warning of their dangers, and I strongly supported the Biden admin’s rule to crack down on them. Today, seven members of the Supreme Court followed the law and did not capitulate to special interests like the NRA. Our kids and cops will be safer for it.”

New York Attorney General Letitia James took credit, writing, “I urged the U.S. Supreme Court to uphold this rule because we know ghost guns are just as dangerous as regular firearms, and they put all of us in danger. Commonsense gun regulations help save lives.”
