Led by Republican Sen. Eric Schmitt (Mo.), the Senate Judiciary Subcommittee is holding a hearing Tuesday afternoon to examine protecting American citizenship, focusing on birthright citizenship for illegal aliens and tourists.
Ahead of the hearing, Schmitt announced:
Today I am chairing a Subcommittee on the Constitution hearing on Birthright Citizenship.
The question we must answer: Is American citizenship the inheritance of a nation and a people, or is it hollow and vacuous with no protections against fraud, abuse, and bad actors? 🧵
Last month, I filed an amicus brief at the Supreme Court arguing that the 14th Amendment never granted automatic citizenship to the children of illegal aliens and tourists—those inside our borders without any connection to our national political community.

My hearing today is going to articulate Article I’s perspective on the issue: we never passed a constitutional amendment that left us so exposed to fraud, abuse, and bad actors.
Our current misapplication of the 14th Amendment puts us in the minority of countries on the issue.
I am calling three witnesses:
• Chuck Cooper, to discuss the Article I perspective,
• @Ilan_Wurman, to discuss the Common Law perspective, and
• @PeterSchweizer, to shed light on the abuse rampant under the Left’s interpretation of the 14th Amendment.

On America’s 250th birthday, we should be asking the biggest question of all: what does it mean to be an American? Citizenship defines the people who govern this republic. Protecting it means protecting the country. Our current system leaves us vulnerable to bad actors.
The Supreme Court will hear oral arguments on April 1 in Trump v. Barbara, where it is expected to answer the question of Birthright Citizenship for the first time.
My hearing today in the Subcommittee on the Constitution will be Article I’s answer to that question. Tune in.

Schmitt’s opening statement warned of the dangers of children born to illegal aliens being given U.S. citizenship, as well as the Chinese birth tourism scheme, in which Chinese women come to the U.S., give birth, then return to China to raise their children, who are now U.S. citizens.
Democrat Sen. Peter Welch (VT) then launched into a tirade about the Trump administration cracking down on illegal immigration.
