From Breitbart: A judge in Orange County, California, has rejected an effort by the Democrat-run state to block the City of Huntington Beach from enforcing a voter ID law that local voters passed by referendum last year, at least for municipal elections.

Huntington Beach, “Surf City USA,” often bucks the left-wing trend in California, fighting back against coronavirus restrictions, amnesty for illegal aliens, “affordable housing” requirements, and a Democrat-backed ban on voter ID.

Gov. Gavin Newsom (D) signed a statewide ban on voter ID into law last year in response to Measure A, passed by local voters last spring. But the city argues its independent powers under state law give it control of its own elections.

A county judge agreed, according to the Orange County Register:

“There is no showing that a voter identification requirement compromises the integrity of a municipal election,” Orange County Superior Court Judge Nico Dourbetas wrote in his ruling.

However, the battle is likely not over yet.  The report explains that the case will now advance through the state appellate system, where the left-wing California Supreme Court is likely to side against the city.  Potentially, it may end up with an appeal to the Supreme Court.

The City of Huntington Beach released the following statements:

Statement on Behalf of Mayor Pat Burns:

Today, we are pleased to announce that the City of Huntington Beach prevailed against the State of California and Mark Bixby’s Writs of Mandate in the Superior Court concerning the City’s right to require voter identification in its local elections. The Superior Court denied both Writs seeking to invalidate Section 705 of the City Charter concerning our new Voter ID law. This is a huge victory not only for our City but charter cities throughout the State. By prevailing against both Writs of Mandate, we have not only successfully defended our City’s Voter ID law, but also the constitutional authority of charter cities rights from attacks by the Attorney General and the State of California. We will not back down in our efforts to secure local control over our local issues and will continue to fight for the City. Thank you to our new City Attorney Mike Vigliotta and the City Attorney team for their effective advocacy. Great job!

City Attorney Mike Vigliotta said, “I am pleased that Superior Court carefully analyzed the law and came to the correct conclusion regarding California Constitution, Art. XI, §5, reservation giving charter cities the authority to “make and enforce all ordinances and regulations in respect to municipal affairs.” The US Supreme Court has already determined that voter ID does not violate the right to vote. While we anticipate this fight isn’t over, we are pleased with the Court’s fair and just evaluation of the weakness of the State and Bixby’s legal case. I am honored that the Council chose me to continue to fight for Huntington Beach, for the integrity of our elections systems, and for just outcomes under the law.”
