From Fox News: The Supreme Court on Tuesday agreed to extend its temporary stay of a lower court order that the Trump administration immediately pay the full Supplemental Nutrition Assistance Program (SNAP) benefits for the month of November, delivering a near-term win to the administration, just hours after it appealed the matter to the high court for emergency intervention.
Trump officials had urged the Supreme Court in a supplemental brief Monday afternoon to keep in place an emergency stay handed down by Justice Ketanji Brown Jackson last week. The new action keeps the stay in place through 11:59 p.m. on Thursday, Nov. 13.
U.S. Solicitor General D. John Sauer had asked the Supreme Court Monday to grant an emergency stay ordering them to resume full SNAP payments before the end of the government shutdown in Congress.
At issue was whether the Trump administration must resume full SNAP benefit payments for the month of November, after they lapsed at the start of the month during the government shutdown.
Approximately 42 million (or one out of every 8 people in the U.S.) are reliant on SNAP benefits to help buy groceries.
A lawsuit was filed against the Trump administration on October 28 by 25 Democrat-led states and the District of Columbia, demanding that the government tap into a $5 billion contingency fund to keep the money flowing for SNAP aid amid the government shutdown.
On Thursday, Obama-appointed judge John J. McConnell Jr. ordered the Trump administration to pay the full amount of SNAP benefits for the month of November, which would total around $9 billion, no later than Friday night.
The contingency fund reportedly only contained about $5 billion, and the USDA had argued that the “contingency funds are not legally available to cover regular benefits.”
Supreme Court Justice Ketanji Brown Jackson, a liberal, had granted the Trump administration an extension until Tuesday at midnight. Now the Supreme Court has granted another stay for two more days.
By that time, the shutdown may be officially ended, which would make the entire case moot.
Attorney General Pam Bondi announced Tuesday night, “Our @TheJusticeDept attorneys just secured a further administrative stay through Thursday at midnight at the Supreme Court to prevent further judicial upheaval for the SNAP and Child Nutrition programs.
“Thank you to the Court for allowing Congress to continue its swift progress to end the shutdown WITHOUT last-ditch disruption from lower courts. We will continue fighting and winning to protect President Trump’s agenda from meritless judicial activism.”

New York Attorney General Letitia James, one of the Democrat attorneys general who had sued the Trump administration, fumed, “This decision by the U.S. Supreme Court means millions of Americans will once again be left wondering how they will feed their families. We hope to see an end to this suffering soon, as the government reopens and SNAP is once again fully funded.”
