In a major win for the Trump administration Monday afternoon, the Supreme Court ruled that the administration may continue to use the Alien Enemies Act of 1798 to deport illegal aliens from the United States who are deemed to be members of the violent Venezuelan Tren de Aragua gang.
This overturns the ruling by Democrat Judge James Boasberg last month, who had ordered two planes already en route to El Salvador with 261 illegal aliens to turn around and bring them back to the United States. The Trump administration said the planes were already over international waters, and the planes proceeded to El Salvador, where the gang members were then taken to that country’s mega prison.
The ACLU had filed a lawsuit, trying to stop the deportations.
In their ruling on Monday, the Supreme Court noted that the Tren de Aragua (TdA) gang has been designated by the U.S. State Department as a foreign terrorist organization.

In a bitterly divided 5-4 decision, the court said the administration must give Venezuelans who it claims are gang members “reasonable time” to go to court.
But the conservative majority said the legal challenges must take place in Texas, instead of a Washington courtroom.
In dissent, the three liberal justices said the administration has sought to avoid judicial review in this case and the court “now rewards the government for its behavior.” Justice Amy Coney Barrett joined portions of the dissent.

Attorney General Pam Bondi announced: “BREAKING: The Supreme Court sides with the Trump Administration on the Alien Enemies Act. Tonight’s decision is a landmark victory for the rule of law. An activist judge in Washington, DC does not have the jurisdiction to seize control of President Trump’s authority to conduct foreign policy and keep the American people safe. The Department of Justice will continue fighting in court to make America safe again.”

DHS Secretary Kristi Noem also cheered the SCOTUS ruling, writing, “President Trump was proven RIGHT once again! SCOTUS confirms our Commander-in-Chief Donald J. Trump has the power to stop the invasion of our country by terrorists using war time powers. LEAVE NOW or we will arrest you, lock you up and deport you.”
