SCOTUS DANGER: Biden’s plan to reverse Trump immunity decision through constitutional reform

According to a report, President Biden is set to propose several changes to the U.S. Constitution on Monday, aiming to fulfill his promise of Supreme Court reform. After previously resisting alterations to the high court, Biden announced on Wednesday that reforming the Supreme Court would be a top priority for the remainder of his term.

This announcement came just before Biden revealed on Sunday that he would not seek re-election, following pressure from Democratic Party officials after his poorly received debate performance in June.

Biden is expected to propose term limits for Supreme Court justices, which would require a constitutional amendment, and the establishment of an enforceable code of ethics, which could be enacted by Congress, Politico reported. Additionally, Biden is likely to support a constitutional amendment to limit immunity for presidents and certain other officeholders, following a Supreme Court ruling in July that presidents cannot be prosecuted for “official acts” during their time in office, stemming from a case involving former President Trump.

Amending the Constitution is intentionally challenging. Any proposed amendment must pass with a two-thirds majority in both the House and the Senate before being sent to the states for ratification. It then requires approval from three-fourths (38) of the 50 states to become the supreme law of the land.
