REPORT: Trump makes special request to Supreme Court regarding TikTok ban

From the Associated Press: President-elect Donald Trump asked the Supreme Court on Friday to pause the potential TikTok ban from going into effect until his administration can pursue a “political resolution” to the issue.

The request came as TikTok and the Biden administration filed opposing briefs to the court, in which the company argued the court should strike down a law that could ban the platform by Jan. 19 while the government emphasized its position that the statute is needed to eliminate a national security risk.

“President Trump takes no position on the underlying merits of this dispute. Instead, he respectfully requests that the Court consider staying the Act’s deadline for divestment of January 19, 2025, while it considers the merits of this case,” said Trump’s amicus brief, which supported neither party in the case and was written by D. John Sauer, Trump’s choice for solicitor general.


During Trump’s first term in office, he had pushed for the app to be banned over national security concerns, as it has a Chinese parent company, and concerns have arisen that the Chinese government could access data about American users.

However, Trump joined TikTok during his presidential campaign, and his team used the app to connect with young voters.

Oral arguments are scheduled for January 10, as the Supreme Court must decide whether the law signed by Joe Biden is a violation of the First Amendment. The law requires TikTok to divest from its China-based parent company, ByteDance, or face a ban in the U.S.

The law, as currently in place, requires TikTok to be sold from ByteDance by January 19 – which is one day before Trump’s inauguration.

“This unfortunate timing interferes with President Trump’s ability to manage the United States’ foreign policy and to pursue a resolution to both protect national security and save a social-media platform that provides a popular vehicle for 170 million Americans to exercise their core First Amendment rights,” Trump’s legal brief reads. “The Act imposes the timing constraint, moreover, without specifying any compelling government interest in that particular deadline.”

Trump told reporters during a recent press briefing at Mar-a-Lago, “We’ll take a look at TikTok. I have a warm spot in my heart for TikTok because I won youth by 34 points.”

Prominent X user and MAGA supporter Tony shared a pro-Trump video on X just after the election, and said the same video “currently has 7M views and 1.3M likes on TikTok.”

Trump also praised TikTok at the recent Turning Point USA AmFest event in Phoenix.

Harry Sisson, a young Democrat activist and fierce Trump opponent, is actually praising Trump for trying to save TikTok.
