UPDATE: A vote on this controversial nominee took place at noon today, Wednesday, Dec. 11.  However, two outgoing senators, Joe Manchin and Kirsten Sinema, both former Democrats who switched to Independent, saved the day and voted “NO,” defeating Schumer’s efforts to lock in this appointment.   See details below.

From the Daily Caller: Senate Democrats are racing to cement President Joe Biden’s labor agenda with a vote on a controversial nominee slated to occur later this week.

Senate Majority Leader Chuck Schumer moved to expedite National Labor Relations Board (NLRB) chair Lauren McFerran’s nomination for a second term Monday evening with a procedural vote likely to be scheduled for Wednesday. If McFerran clears the procedural vote hurdle and a majority of senators vote in support of McFerran’s renomination, Democrats will secure a majority on the five-person NLRB until 2026, preventing President-elect Donald Trump from selecting his own pick as chair.

The NLRB is an independent federal agency that resolves labor disputes and oversees elections in workplaces attempting to unionize. Republicans have sharply criticized the NLRB under McFerran’s leadership over allegations of “misconduct” in administering secret ballot elections and the board’s attempts to increase union activism in private sector workplaces.

Democrats currently command a 3 to 1 majority on the NLRB with McFerran’s term set to expire this month and one of the board’s Republican seats unfilled.

“Confirming the NLRB nominees is one of our highest priorities, and we’re going to do everything we can do to get it done by the end of the year,” Schumer had announced on November 23.

Schumer is reportedly gambling on some Senate Republicans being absent for the vote, giving them more leverage to get McFerran voted in.

The vote is scheduled to begin at noon on Wednesday.

Sen. (Coach) Tommy Tuberville (R-Al.) wrote Wednesday morning, “I hope my Senate colleagues will join me in voting against Lauren McFerran to chair the National Labor Relations Board today. The American people delivered a MANDATE for the America First agenda on November 5th – now is not the time to be ramming through @JoeBiden’s liberal nominees.”

Turning Point USA founder Charlie Kirk announced Tuesday, “EMERGENCY: Chuck Schumer is trying to ram through Dem activist Lauren McFerran for another term chairing the National Labor Relations Board—a very big deal. If successful, we will have a Dem Chair of the NLRB for the first 2 YEARS of Trump’s Presidency. We need every GOP Senator to show up and block her!”

Many business organizations are sounding the alarm over McFerran being reappointed.

The Associated Builders and Contractors organization has issued a letter voicing their opposition to McFerran’s renomination.

The National Federation of Independent Business (NFIB) has also voiced their opposition to McFerran.

And the Small Business & Entrepreneurship Council (SBE) is also opposing McFerran.

Job Creators Network sounded the alarm earlier this summer:

The Public Labor Unions Accountability Committee also sounded the alarm by sharing a video during a congressional hearing.

The Independent Women’s Forum is opposing McFerran.

The International Franchise Association is also opposing McFerran.

Investigative reporter Natalie Winters announced:

Democrats are jamming through Lauren McFerran, an anti-worker radical, to the National Labor Relations Board. She has consistently sided with corrupt union leaders. Schumer says this is one of his “highest priorities.”

Republicans don’t support her but since floor attendance has been weak, there’s a chance she could be reconfirmed.
