REPORT: GOP allegedly secures midnight deal with Dems to save four coveted judicial nominations for Trump, GOP senators slammed for being AWOL during key votes

From Fox News: Senate Democrats and Republicans struck a late-night deal on judicial votes and confirmations on Wednesday, securing the ability for President-elect Trump to appoint four crucial appellate court judges in his second administration.

As Senate Majority Leader Chuck Schumer, D-N.Y., attempts to push through as many President Biden judicial picks as possible, Republicans in the upper chamber have worked to delay the process by using procedural floor maneuvers, causing several late nights.

Around midnight on Wednesday, the parties came to an agreement which would allow Democrats to hold votes on four district court judges in exchange for pulling four higher tier circuit court judicial nominees, a senior GOP Senate source familiar with the matter told Fox News Digital.

These four vacancies will now be Trump’s to fill, per the deal, the source said.


Sens. Mike Lee, R-Utah, and Eric Schmitt, R-Mo., were both key figures in securing the near-midnight deal, the report explains.

However, a Senate Democrat leadership aide has released a statement saying the deal is NOT a trade of four district judges for four circuit court judges.

“The trade was four circuit nominees — all lacking the votes to get confirmed — for more than triple the number of additional judges moving forward,” a spokesperson for Schumer said in a statement to Fox News.

Schumer has been frantically working to push Biden’s radical judicial picks through, and is doing it during times when some of the Republican senators are absent and not there to vote against them.

On Tuesday, Sen. Ted Cruz (R-Tex.) and Sen. Bill Hagerty (R-Tenn.) went with Trump to Texas to watch Elon Musk’s SpaceX launch.

Outgoing Sen. Mike Braun (R-Ind.), who won his bid to become Indiana’s next governor, was also missing in action from the senate votes on Monday, Tuesday and part of Wednesday, as he was off attending the Republican Governors Association’s annual conference in Florida.

Vice President-elect JD Vance of Ohio was also absent for some of the key judicial votes.

Kamala Harris, who would normally serve as a tie-breaker for the Democrats, had left Tuesday for a weeklong trip to Hawaii, so if all 50 Republican senators had been in attendance, many of the radical judicial nominees potentially could have been blocked.

On Tuesday, Schumer touted, “The Senate will keep working to confirm @POTUS’s excellent nominees: We’ve just moved forward on the nomination of Mustafa Kasubhai to be a District Judge for the District of Oregon. And we’ll expect to vote on confirming as many as three judges today!”

Schumer added, “I’m proud of the judges we’ve confirmed. We have more judges from consumer protection, civil rights, voting rights backgrounds. We’ve confirmed more women and people of color. All are highly qualified, and their broad experience and expertise is an additional asset to the bench.”

Trump blasted out a warning, “The Democrats are trying to stack the Courts with Radical Left Judges on their way out the door. Republican Senators need to Show Up and Hold the Line — No more Judges confirmed before Inauguration Day!”

Gail Weilheimer to be a District Judge for the Eastern District of Pennsylvania

Outrage has erupted over the AWOL Republican senators, who ultimately allowed the radical judges to be confirmed.  Even Sen. Joe Manchin voted against some of the judges – and Republicans were not there to do their part.
