POLL: Should all elected members of Congress, and all judges, be born in the USA?

The U.S. Constitution requires that anyone running for President of the United States be a natural born citizen. Additionally, they must have been a resident of the U.S. for at least 14 years, and be at least 35 years old.

However, the same rule does not apply for members of Congress, as they are not required to have been born in the U.S.

To serve in the U.S. House of Representatives, a person simply must have been a U.S. citizen for at least 7 years and be at least 25 years old.  To serve in the U.S. Senate, the person must have been a U.S. citizen for at least 9 years, and be at least 30 years old.

There are a number of foreign-born people serving in Congress. Some are Republicans, but the majority are Democrats. There are also many foreign-born state legislators, and several mayors.

Last week, Democrat Rep. Shri Thanedar of Michigan file articles of impeachment against President Donald Trump. Thanedar, 70, was born in India, and did not even grow up in the United States. He came to the U.S. in 1979 to attend the University of Arkron in Ohio, became a U.S. citizen in 1988, and still speaks in very broken English.  But he wants to impeach a duly-elected American president.

Shockingly, the U.S. Constitution does not specify that federal judges, including Supreme Court justices, be U.S. citizens. Therefore, in theory, a noncitizen could be appointed to these roles.

Many federal judges have ruled against President Trump, as Democrats attempt to thwart his agenda by filing lawsuit after lawsuit.  Multiple judges blocking Trump’s executive orders have been foreign-born.

For example, U.S. District Judge Amir H. Ali, who is overseeing a lawsuit against the Trump administration over its decision to suspend foreign assistance, was born in Canada, and only obtained his U.S. citizenship in 2019. He was one of the last group of radical judges appointed by Joe Biden and confirmed by Senate Democrats just two months before Biden left office. Ali became the first Muslim and Arab American federal judge to serve in D.C.
