Yesterday, former Marine Daniel Penny was acquitted of criminally negligent homicide in the 2023 death of Jordan Neely.

Penny’s defense argued he was protecting himself and other passengers from Neely, who exhibited alarming behavior but was unarmed. Prosecutors claimed Penny overreacted.

The jury deadlocked on a more serious manslaughter charge, which was dismissed earlier.

Neely, a former subway performer, suffered from mental illness and had drugs in his system at the time of his death. Passengers were fearful for their lives when Neely threatened to kill everyone.
