The policy, which labels gender dysphoria as a disqualifying medical condition, allows the Pentagon to discharge transgender service members and bar new enlistments. Supporters argue the ban enhances military readiness by avoiding disruptions from medical treatments and maintaining unit cohesion, citing the Pentagon’s claim that gender dysphoria could impair operational effectiveness. They also contend it aligns with traditional military standards, prioritizing physical and mental uniformity. The decision is seen as reinforcing executive authority over military policy, especially under Trump’s directive to eliminate “gender radicalism.”

Critics, including the court’s three liberal justices—Sotomayor, Kagan, and Jackson—who dissented without explanation, view the ruling as discriminatory. Leftist groups like Lambda Legal and the Human Rights Campaign called it a “devastating blow,” arguing it punishes transgender service members for their identity, not their performance. They claim the ban lacks evidence, noting transgender troops, like lead plaintiff Navy pilot Emily Shilling, have served honorably with no detriment to readiness. Critics also argue the policy’s blanket nature ignores individual capabilities and violates equal protection principles.
