From the New York Times: Chief Justice John G. Roberts Jr. on Monday temporarily blocked a trial judge’s order directing the United States to return a Salvadoran migrant it had inadvertently deported.
The chief justice, acting on his own, issued an “administrative stay,” an interim measure meant to give the justices some breathing room while the full court considers the matter.
The order came just hours after the administration asked the court to block the trial judge’s order instructing the government to return the migrant, Kilmar Armando Abrego Garcia, by 11:59 p.m. on Monday.
Judge Paula Xinis of the Federal District Court in Maryland had said the administration committed a “grievous error” that “shocks the conscience” by sending Mr. Abrego Garcia, to a notorious prison in El Salvador last month.
In the administration’s emergency application, D. John Sauer, the U.S. solicitor general, said Judge Xinis had exceeded her authority by engaging in “district-court diplomacy,” because it would require working with the government of El Salvador to secure his release.
ABC News shared the following backstory on Garcia:
In March, Abrego Garcia, whose wife is a U.S. citizen and who has 5-year-old child, was stopped by Immigration and Customs Enforcement officers who “informed him that his immigration status had changed,” according to his attorneys. He was detained and then transferred to a detention center in Texas before being sent to El Salvador.
Abrego Garcia entered the United States in 2011 when he was 16 to escape gang violence in El Salvador, according to his lawyers. Simon Sandoval-Moshenberg, the attorney representing Abrego Garcia, said last week his client is not a member of MS-13, as the government has alleged, but said that’s an issue for an immigration judge to address.

Democrats have been demanding that the Trump administration bring Garcia, an illegal alien, back to the United States.
Progressive Rep. Pramila Jayapal (D-Wash.) fumed, “Two federal courts have ordered the Trump admin to return Kilmar Armando Abrego Garcia to his US citizen wife & child in Maryland.
