NEWS ALERT: Supreme Court takes up major elections dispute over counting of late-arriving mail ballots

From CBS News: The Supreme Court on Monday said it will decide whether federal law prohibits states from counting mail-in ballots that arrive after Election Day.

The legal battle before the court involves Mississippi’s procedures for counting late-arriving absentee ballots, but comes as the justices are considering whether to revive a Republican congressman’s lawsuit challenging a similar law in Illinois.

The Supreme Court heard arguments in that case, brought by Rep. Michael Bost, in October, though the question before it is a procedural one.ele

The court fight involving Mississippi’s law, though, involves the meaning of “Election Day” and could have ramifications for the slew of states that allow for the counting of mail-in ballots that are received after the day of the election just ahead of the 2026 midterm elections.


The report explains that sixteen states currently will accept and count a mail-in ballot if it arrives after election day but is postmarked on or before it.

In July, the Associated Press reportedAt least three states — Kansas, North Dakota and Utah — passed legislation this year that eliminated a grace period for receiving mailed ballots, saying they now need to be in by Election Day.

One Canadian responding to the news wrote, “I still don’t understand why this is a thing. Here in Canada, if Elections Canada does not receive your ballot by the time polls close it is not counted, no ifs ands or buts. It is your job to get your ballot to them in time.”
