Non-citizens, including green card holders and illegal aliens, are not eligible for jury duty in the United States. If a non-citizen receives aa summons for jury duty, they are supposed to check a box declaring they are not a citizen and return the form so they can be dismissed.
That’s right, non-citizens are being summoned to jury duty in the United States, and it is up to them to come forward and voluntarily admit they are not a citizen.
This is reportedly happening because the jury selection process randomly pulls people from a state’s Motor Vehicle Department driver’s license list to serve on jury duty.
Sounding the alarm over the situation in Michigan is Macomb County Clerk Anthony Forlini, a Republican running for Michigan Secretary of State, who held a press conference to discuss the situation on Tuesday.
Forlini warned that some of the non-citizens who had been summoned to jury duty had even registered to vote.
The information Forlini exposed was just in Macomb County only, which is an area just northeast of Detroit. Just during a four-month period, his team found 239 non-citizens in the jury pool. Out of those, 14 were registered to vote, and at least one had voted in multiple elections.
Forlini credited Republican activist Scott Presler with helping him to uncover the information.
Posting a press release, Forlini wrote, “Yesterday in Macomb County we uncovered more problems with procedure and how elections are run. This is very alarming and hints at a larger issue statewide.
“When I am Secretary of State, we will pay attention to these details, tightening our system so elections and processes are run according to the law. Special thanks to Scott Presler and others for elevating this issue. Every vote matters. Every vote must count. We will make Michigan better.”

In Michigan, anyone who applies for a driver’s license is automatically registered to vote, unless they choose to decline. If presented with a voter registration form, it is up to the individual to check a box if they are not a U.S. citizen.
“Unlike some states, Michigan does not currently use a federal citizenship database or systematic federal verification to confirm the status at the time of registration,” Forlini warned.
Michigan Secretary of State Jocelyn Benson, a Democrat who is now running for governor of Michigan, defended the program, and released the following statement to Fox2Detroit:
“The jury pool is drawn from the driver’s license database, not the voter database. Individuals who are legally present in the U.S. can get driver’s licenses or state IDs in Michigan.”
“Only U.S. citizens who are Michigan residents, are 18 years old by Election Day, and are not currently serving a sentence in jail or prison can vote in Michigan elections. The Michigan Department of State regularly investigates reports of voting fraud and will make referrals to law enforcement for further investigation if merited.”
“If the clerk has concerns about data he is viewing in QVF, we invite him to reach out to the Bureau of Elections so we can investigate.”
