From Fox News: Prosecutors in Colorado plan to drop charges against a registered sex offender accused of trying to kidnap a child from an elementary school because he was found incompetent to stand trial.

The 18th Judicial District Attorney’s Office, which covers Arapahoe County and includes Aurora and Littleton, informed FOX31 on Friday that it intends to dismiss charges against Solomon Galligan. The 33-year-old faces one count of attempted kidnapping after he allegedly tried to take an 11-year-old boy during recess at Black Forest Hills Elementary School in April 2024.

Aurora police previously reported that Galligan is a registered sex offender, with his registration tied to the Pueblo County Sheriff’s Office.

After his arrest, Galligan underwent a mental competency evaluation that determined he was unfit to stand trial. As a result, prosecutors claimed they have no choice but to drop the charges.


The report notes that prosecutors have no doubt about Galligan’s guilt, as the attempted kidnapping of the child was all caught on video. However, the DA’s office announced they are “planning to drop charges against the defendant, which is required by law when they are found mentally incompetent to stand trial.”

The alarming incident happened when students were playing in a field during recess at Black Forest Hills Elementary School in Aurora.

Galligan approached the children, who all started screaming “stranger danger” and fleeing towards the school. Galligan tried to snatch one 11-year-old boy, but the child managed to escape when Galligan tripped on a blanket he was carrying.

A parent later saw Galligan at a Walgreens store, and police went to apprehend him. When they ran a background check on Galligan, they found he was a registered sex offender since 2011.

Galligan, a biological man, also appears to be a transgender. After his arrest, CBS News reported, “In court, Galligan was said to identify as she/her.”

Based on a statement found on Galligan’s Facebook page, it appears a gender transition was also being started that same year, although it is unclear whether that was completed.

On March 19, 2011, Galligan announced, “so im starting my hormone shots and i relly cant wait im on my hormone pills ive been on them for almost 4 months i wake up all depressed and crying but in the end its gonna be totally worth it you know what io mean im really excited my measurements are already changing and im super thrilled.”

Last year, Galligan’s family said the “system” has failed him, and said he’s been in and out of jail for the past 12 years.
