NEWS ALERT: Judge orders Trump administration to seek return of second deported illegal alien

From PoliticoThe Trump administration must seek to return a second man who was improperly deported from the U.S. to El Salvador in violation of a previous court order, a federal judge ruled Wednesday.

U.S. District Judge Stephanie Gallagher, a Maryland-based Trump appointee, ruled that the administration deported a 20-year-old Venezuelan man last month in violation of a legally binding, court-approved settlement agreement reached in a lawsuit last year. Under that settlement, the U.S. agreed not to deport migrants who arrived as unaccompanied minors until their asylum claims are fully adjudicated.

The man, identified in court papers only as “Cristian,” arrived in the U.S. as an unaccompanied minor and sought asylum in December 2022. That claim was still pending when he was deported last month.


In the ruling, Judge Gallagher wrote, “Defendants are hereby ORDERED to facilitate Class Member Cristian’s return to the United States to await the adjudication of his asylum application on the merits.”

“Defendants have provided no evidence, or even any specific allegations, as to how Christian, or any other Class Member, pose a threat to public safety,” the judge claimed.

The court document acknowledges that ICE had determined Christian is a member of TdA. He was reportedly deported on March 15 under the ‘Alien Enemies Act’ and sent to El Salvador’s CECOT prison.

WPSDLocal6.com reported that Christian was also busted for possession of cocaine:

A sworn declaration from Robert Cerna, the ICE acting Field Office Director for Enforcement and Removal Operations, said Cristian had been arrested in Texas in January.

“On January 6, 2025, (‘Cristian’) was convicted in the 482nd District Court at Harris County, Texas, for the offense of possession of cocaine,” Cerna stated in the filing. Cerna added that Immigration and Customs Enforcement determined Cristian was subject to removal following the invocation of the AEA.
