From Fox News: The illegal immigrant accused of killing a University of South Carolina student in a hit-and-run crash is being held without bail, jail records show.
Rosali I. Fernandez Cruz, 24, is accused of striking and killing Nathaniel Baker, 21, in Columbia, South Carolina, on Tuesday.
Baker was a junior at the University of South Carolina and is remembered fondly by his Phi Gamma Delta fraternity brothers.
Fernandez Cruz, an illegal immigrant against whom Immigration and Customs Enforcement (ICE) has lodged a detainer hold, is accused of failing to yield and striking Baker, who was riding a motorcycle.
Police say after striking the motorcycle Baker was riding on, Cruz, who was driving without a license, drove away from the scene, then bailed out of the pickup truck along with two other male passengers and took off running.
Police caught up with Cruz and arrested him, but reportedly have not filed any charges against the two passengers.
Fernandez-Cruz was first apprehended by Border Patrol in Hidalgo, Texas, on Dec. 24, 2016, during the last month of the Obama administration, and was apparently released into the country. Nearly two years later, on Sept. 6, 2018, an immigration judge ordered him to be sent back to El Salvador, and has been on the ICE wanted list ever since.
Fox News reporter Bill Melugin wrote, “Per DHS source, this Salvadoran illegal alien had an active deportation order before this happened. He was first arrested by Border Patrol near Hidalgo, TX in December 2016. He was released with a notice to appear. He never showed up – and in September 2018, a DOJ immigration judge in Charlotte, NC ordered him deported in absentia. He was never removed – and is now under arrest for this fatal hit and run, which killed a 21-year-old University of South Carolina student.”

DHS assistant secretary Tricia McLaughlin shared a photo of Baker and wrote, “Yesterday, 21-year-old USC student Nathanial “Nate” Baker was driving a motorcycle when he was hit by a truck driver who fled the scene. The hit & run driver was in our country illegally. Podcast host Chad Prather shared a photo of Baker with his parents and wrote, “Nathanial G. Baker had his entire life in front of him. He was attending college at University of South Carolina where he was tragically KILLED by an illegal in a HIT AND RUN! Rosali I. Fernandez-Cruz was already WANTED by ICE. This THUG should have NEVER BEEN HERE!”

Baker’s fraternity paid tribute to him in an Instagram post:
Yesterday, we lost not just a brother, but a leader, a role model, and a true embodiment of what our fraternity stands for. Nate Baker brought light, laughter, and love into all of our lives. Nate will always be remembered for the way he showed up for others and the impact he had on everyone around him. His passion, loyalty, and love for this brotherhood will never be forgotten. May we honor his memory by living with the same kindness, selflessness and generosity that he showed to everyone around him.
Rest in Peace Nathaniel Baker.

Rep. William Timmons (R-SC) wrote, “I am devastated to learn of Nate Baker’s passing. Nate, a 21-year-old University of South Carolina student, lost his life in a senseless hit-and-run crash caused by an illegal alien, Rosali Fernandez–Cruz. Driving without a license, Fernandez–Cruz struck Nate’s motorcycle with his truck and fled the scene, leaving behind a devastated family and community. This heartbreaking loss underscores the real consequences of unchecked illegal immigration—Nate should still be with us today. Our thoughts and prayers are with his loved ones during this unimaginable time.”
