NEWS ALERT: Federal judge overrules Trump’s authority to send troops amid Portland unrest

From Fox News: A U.S. District Court on Saturday issued a temporary restraining order (TRO) to halt the Trump administration from deploying 200 National Guardsmen to Portland, Oregon, amid violent anti-Immigration and Customs Enforcement (ICE) protests.

The lawsuit, brought by the State of Oregon and City of Portland, argued the deployment was unlawful, exceeding the president’s statutory and constitutional authority.

Judge Karin Immergut, appointed by President Donald Trump in 2019, granted the TRO blocking the federal action.

Trump in June issued a memorandum authorizing the federalization of National Guard troops, citing threats to federal employees and property during protests against immigration enforcement.


Immergut claimed in her ruling on Saturday that Trump’s deployment of the National Guard exceeded his authority “because the law only allows the president to call in the National Guard under exceptional circumstances, including invasion, rebellion or an inability to execute federal law using regular forces.”

The judge said none of those conditions existed in Oregon, and claimed local and federal law enforcement were capable of maintaining order.

However, independent journalist Andy Ngo pointed to a section from the lawsuit in which Portland Police said they were understaffed and incapable of responding to the riots against ICE.

Oregon Attorney General Dan Rayfield, a Democrat, cheered the judge’s decision, “BREAKING NEWS: We just secured a court order blocking the president’s order to deploy federalized National Guard troops to Portland when a federal judge granted our request for a Temporary Restraining Order. Read our statement.”

White House Deputy Chief of Staff Stephen Miller blasted the decision.

“Legal insurrection. The President is the commander-in-chief of the Armed Forces, not an Oregon judge. Portland and Oregon law enforcement, at the direction of local leaders, have refused to aid ICE officers facing relentless terrorist assault and threats to life. (There are more local law enforcement officers in Oregon than there are guns and badges in the FBI nationwide). This is an organized terrorist attack on the federal government and its officers, and the deployment of troops is an absolute necessity to defend our personnel, our laws, our government, public order and the Republic itself,” Miller wrote.
