From Breitbart: A Uruguayan-born judge appointed by President Joe Biden has invented a novel excuse to block President Donald Trump from terminating Biden’s award of Temporary Protected Status (TPS) to 350,000 illegal-migrant Haitians.
The text of the TPS quasi-amnesty law bars judges’ intervention in TPS decisions by saying “There is no judicial review of any [TPS] determination.”
But Judge Ana Reyes, an immigrant and a Harvard graduate, claims that she is still allowed to review the process of the TPS determination:
the word “any determination” captures all determinations the Secretary may make—whether to expand, designate, or terminate—but it does not capture the process by which she reaches that determination.
Ryes then decided that the administration’s process was illegitimate because skilled U.S.-based Haitians do not want to go home to their island because it is governed badly by the left-behind Haitians, despite a U.N.-funded peace-keeping force.
The Temporary Protected Status for the 350,000 Haitians was scheduled to expire Tuesday, February 3. But on Monday, one day before the expiration date, the foreign-born judge stepped in. CBS News reported:
U.S. District Court Judge Ana Reyes indefinitely paused the planned termination of Haiti’s TPS program, explicitly barring the federal government from invalidating the legal status and work permits of active enrollees and from arresting and deporting them.
Reyes claimed that Noem’s decision to not renew TPS for the Haitians failed to fully consider “overwhelming evidence of present danger” in crisis-stricken Haiti, which remains plagued by political instability, gang violence and widespread poverty, CBS News reported.
Reyes also played the “race card,” as she cited “disparaging remarks that the secretary and President Trump have made about Haiti and immigrants.”
DHS spokesperson Tricia McLaughlin reacted in fury, writing, “Supreme Court, here we come. This is lawless activism that we will be vindicated on. Haiti’s TPS was granted following an earthquake that took place over 15 years ago, it was never intended to be a de facto amnesty program, yet that’s how previous administrations have used it for decades. Temporary means temporary and the final word will not be from an activist judge legislating from the bench.”

As a child, she moved to Spain, and then to Kentucky, USA, where her first grade teacher had to help her learn English. She was nominated as a judge by Joe Biden in 2023, and became the first Latina and the first openly gay person to serve as a district court judge in Washington, D.C.
