NEED FOR ‘CAUTION’: Secret health scare of conservative SCOTUS justice uncovered as liberals fear court shake-up

From ABC NewsSupreme Court Justice Samuel Alito was treated at a hospital last month after leaving early from a Federalist Society dinner in Philadelphia in his honor, several sources briefed on the event told ABC News.

Alito, who marks 20 years on the bench this year and recently turned 76, was supposed to give the keynote address at the March 20 event but did not make remarks.

He was described by those who saw him that evening as appearing “tired” and not as engaging as usual, remaining seated as attendees came over to greet him during the dinner, according to the sources.


A Supreme Court spokesperson, Patricia McCabe, said in a statement to ABC News:

“Out of an abundance of caution, he agreed with his security detail’s recommendation to see a physician before the three-hour drive home.

“After that examination and the administration of fluids for dehydration, he returned home that night, as previously planned. Justice Alito was thoroughly checked by his own physician, and he returned to work the following Monday for oral argument.”

Alito is the second-oldest member of the Supreme Court. The oldest is Justice Clarence Thomas at 77.

Meanwhile, a liberal group is worried that Trump may need to appoint another conservative justice to the bench, and their scheming to prevent it.

Demand Justice, an advocacy group created to oppose Trump’s agenda, is raising millions for a preemptive campaign against his potential Supreme Court picks.

None of the nine Justices have announced plans to retire, nor has Trump shared any machinations to replace any of the aging members of the court.

But Alito’s scare has sharpened attention on the age of the court’s conservative wing.

Demand Justice president Josh Orton, a former adviser to Kamala Harris and Bernie Sanders, announced a $3 million campaign on Friday to oppose any Trump Supreme Court nominee, with the war chest set to balloon to $15 million should a vacancy actually open.
