In a case that could have major impacts, the Supreme Court is hearing arguments Wednesday morning on “Trump v. Barbara,” which addresses the constitutionality of President Donald Trump’s executive order on birthright citizenship.

Soon after taking office last year, President Trump signed an executive order stating that babies born in the U.S. to illegal aliens or foreign tourists are NOT eligible for U.S. citizenship.

The order seeks to end the practice of “anchor babies,” where illegal aliens are able to cross the border and give birth, securing U.S. citizenship for their babies, which makes them eligible for welfare assistance, and the ability to sponsor their relatives for green cards once they become of legal age.

The order would also end the practice of birth tourism, which is widely occurring by the Chinese.

Trump told reporters in the Oval Office Tuesday evening that he planned to attend the arguments in person, and was seen leaving the White House in his motorcade Wednesday morning to travel to the Supreme Court.

“Chinese billionaires and billionaires from other countries who all of a sudden have 75 children or 59 children in one case or 10 children, becoming American citizens,” Trump told reporters on Tuesday. “[The 14th Amendment] was about slaves … all of this legislation, all of this having to do with birthright citizenship, it was at the end of the Civil War. The reason was, it had to do with the babies of slaves and the protection of the babies of slaves.”

“It didn’t have to do with the protection of multi-millionaires and billionaires wanting to have their children getting American citizenship. It is the craziest thing I’ve ever seen,” he added.

The Citizenship Clause includes a phrase which states, “All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.”

Those supporting birthright citizenship claim this phrase means anyone born on U.S. soil receives U.S. citizenship, with the exception of children born to foreign diplomats (who are not subject to U.S. jurisdiction).

However, conservatives argue that persons in the U.S. illegally are also not subject to U.S. jurisdiction and have no right to citizenship.  It has also been noted that the 14th Amendment was originally passed after the Civil War to ensure that children born to slaves and former slaves in the U.S. would be guaranteed U.S. citizenship.

“Birthright Citizenship has to do with the babies of slaves, not Chinese Billionaires who have 56 kids, all of whom “become” American Citizens. One of the many Great Scams of our time!” Trump wrote in a Truth Social post on Tuesday.
