In a stern post on Truth Social Tuesday evening, President Donald Trump announced that anything and everything signed by Joe Biden’s autopen is now declared NULL AND VOID – including all pardons.
On Friday, Trump had made a similar announcement, noting that 92% of documents signed during Biden’s presidency were done so with the device, and said the people who operated the autopen had done so illegally.
All presidents have occasionally used the autopen for certain documents, but it is supposed to be done with the president’s authorization. However, it is widely believed that Biden was not even aware of many documents his team signed with the autopen.
President Trump doubled down Tuesday, confirming that all pardons signed by Biden’s autopen are also declared null and void. Biden is known to have personally signed at least one pardon – which was for his scandal-plagued son, Hunter Biden.
On Biden’s last day in the Oval Office, on January 20, 2020, last-minute pardons were issued for his brother James Biden and other relatives for unspecified crimes.
Also on January 20, blanket preemptive pardons were issued for Anthony Fauci, the former director of the National Institute of Allergy and Infectious Diseases; retired Gen. Mark Milley, the former chairman of the Joint Chiefs of Staff; and the lawmakers and staffers from the House committee that investigated the Capitol attack on Jan. 6, 2021, including former GOP Reps. Liz Cheney of Wyoming and Adam Kinzinger of Illinois; and Sen. Adam Schiff, D-Calif.
In December 2024, Biden commuted 1,500 prison sentences and pardoned 39 people in what the White House described as the largest act of clemency in a single day in modern presidential history, NPR had announced.
Additionally, just days before leaving the Oval Office, Biden announced that he was commuting the sentences of nearly 2,500 people convicted of nonviolent drug crimes who he said were given unusually long sentences.
All of those pardons are believed to have been signed by the autopen.
President Trump announced Tuesday evening:
Any and all Documents, Proclamations, Executive Orders, Memorandums, or Contracts, signed by Order of the now infamous and unauthorized “AUTOPEN,” within the Administration of Joseph R. Biden Jr., are hereby null, void, and of no further force or effect.
Anyone receiving “Pardons,” “Commutations,” or any other Legal Document so signed, please be advised that said Document has been fully and completely terminated, and is of no Legal effect. Thank you for your attention to this matter!
In September, President Trump had newly-framed photos of all American presidents hung up along the West Wing Colonnade. In place of Joe Biden’s portrait, the frame includes an image of the autopen.
