From the Washington Post: The Supreme Court on Thursday backed a lower-court order requiring the Trump administration to “facilitate” the return of a Maryland man who was mistakenly deported to a mega-prison in El Salvador last month.
U.S. District Judge Paula Xinis had ordered Kilmar Abrego García to be brought back to the United States by Monday night, but Chief Justice John G. Roberts Jr. issued a brief pause hours before the deadline, allowing the justices time to weigh a government motion to block the order.
In a brief order, the court said the judge “properly requires the Government to ‘facilitate’ Abrego Garcia’s release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador.”
There were no noted dissents.
Abrego Garcia’s attorneys claim their client is the victim of a “Kafkaesque mistake.” The Trump administration says he is an MS-13 gang member.
Abrego Garcia, 29, from El Salvador, snuck into the United States illegally around 2011, when he was about 15 or 16 years old. He claims a local gang was extorting his family for money, and he fled for his life.
Five years after arriving in the U.S., Abrego Garcia reportedly met Jennifer Vasquez Sura, a U.S. citizen, whom he later married. They have a 5-year-old child, and she has two older children.
Vasquez denies Abrego Garcia is an MS-13 gang member, and told ABC News, “Everything they are saying is wrong. My husband is a loving father and what I know is that he’s an amazing husband, an amazing father. That’s who he truly is.”
Now the Supreme Court says the Trump administration must bring Abrego Garcia back to the U.S. from the El Salvador mega prison.
Speaking on Fox News after the ruling, Sen. Eric Schmitt (R-Mo.) said Abrego Garcia IS deportable because he is an MS-13 gang member, and will be held in detention after he is returned to the U.S.
“He will be deported, he just can’t be deported to El Salvador,” Schmitt suggested.

Democrats are fiercely defending the deported illegal alien.
Rep. Eric Swalwell (D-Calif.), who once allegedly dated a Chinese spy, fumed, “There is a special place in HELL for the people who are willing to argue to the Supreme Court that the man they MISTAKENLY sent to an El Salvador prison should stay there.”

Rep. Joaquin Castro (D-Tex.) brazenly declared on Wednesday, “Kilmar Abrego Garcia had a legal right to be in America. He’s a husband, father and working man. Not a criminal. Yet he was deported to a gulag in El Salvador with no due process and Presidents Trump and Bukele refuse to return him to his family in the U.S. We stood with his family today to demand Kilmar’s return.”
