BREAKING: Supreme Court decides on Trump’s bid to delay sentencing in NY ‘hush money’ case

From the Associated Press: A divided Supreme Court on Thursday rejected President-elect Donald Trump’s bid to delay his sentencing in his hush money case in New York.

The court’s 5-4 order clears the way for Judge Juan M. Merchan to impose a sentence Friday on Trump, who was convicted in what prosecutors called an attempt to cover up a $130,000 hush money payment to porn actor Stormy Daniels. Trump has denied any liaison with Daniels or any wrongdoing.

Chief Justice John Roberts and Justice Amy Coney Barrett joined with the court’s three liberals in rejecting his emergency motion.

They found his sentencing wouldn’t be a serious burden since Merchan has indicated he won’t give Trump jail time, fines or probation. Trump’s arguments against the verdict, meanwhile, can be handled as part of the regular appeals process, the majority found.


The four justices in favor of delaying the sentencing were Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh.

Law professor Jonathan Turley released the following statement:

The denial of the Supreme Court on the Trump stay played out as expected. Nothing in the effort would have appealed to Chief Justice Roberts. He is the ultimate institutionalist who not only prefers regular order but a minimal role of the Court in political matters…

There is an overriding preference among appellate judges for the finalizing of cases with sentencing so that the entire case can be reviewed. Justice Amy Coney Barrett also joined the liberal justices in the 5-4 decision…

The sentencing will now go forward. However, in handing down this sentence, Judge Merchan will give Trump an even greater mandate. The New York case is the rawest form of lawfare and Alvin Bragg is its happiest warrior…

…For many of us, Merchan will be rendering a final judgment not just on Trump but the New York courts. The New York courts failed to prevent this weaponization of the legal system…
