BREAKING: Pennsylvania’s top court delivers win to GOP as they defend Senate victory from recount challenge

From Fox News: The Pennsylvania Supreme Court ruled Monday that mail-in ballots with incorrect or missing dates cannot be counted in the 2024 election, delivering a victory to Republican Party officials as they moved to aggressively defend their narrow Senate victory in amid a recount challenge in the Keystone State.

In a 4-3 decision, the state Supreme Court reaffirmed its prior decision that counties in the state cannot count incorrectly dated or undated ballots, explicitly singling out Boards of Elections in Bucks County, Montgomery County, and Philadelphia County, whom they said “SHALL COMPLY with the prior rulings of this Court in which we have clarified” for mail-in and absentee ballots in their Nov. 1 ruling.

The decision is a victory for Republican Party officials, who had filed 12 different lawsuits in the state amid an aggressive Senate recount effort following the narrow victory of Republican candidate David McCormick over three-term Democrat Sen. Bob Casey.

McCormick had defeated Casey by some 17,000 ballots in the state, or within the 0.5% margin of error that allows Casey to qualify for an automatic recount under Pennsylvania law.

The court’s new decision to block the officials was made 7-0 on the merits and 4-3 on procedural matters, with Justice David Wecht, a liberal with no love lost for the GOP, writing in concurrence:

“It is critical to the rule of law that individual counties and municipalities and their elected and appointed officials, like any other parties, obey orders of this Court. As Justice Felix Frankfurter once wrote: ‘If one man can be allowed to determine for himself what is law, every man can. That means first chaos, then tyranny. … The greater the power that defies law the less tolerant can this Court be of defiance.’”

Turning Point USA founder Charlie Kirk announced, “BREAKING: The Pennsylvania Supreme Court has AGAIN ruled in favor of Dave McCormick and the RNC demanding that Democrat counties stop counting misdated, undated, or otherwise disqualified ballots as they attempt to steal the election for Democrat Bob Casey.”

Podcaster Clay Travis wrote, “The Pennsylvania Supreme Court just ruled 7-0 that Casey’s campaign can’t cheat and count illegal votes. It’s long past time for Bob Casey to concede to @DaveMcCormickPA. Why are you still silent
@GovernorShapiro? Do you support election denial?”

Republican activist Scott Presler cheered, “VICTORY! The Pennsylvania Supreme Court just affirmed that Bucks County — & all 67 counties — must comply with/ NOT counting misdated or undated ballots. This is a huge win for election integrity — thank you RNC. We’re showing up Wednesday, anyway.”
