BREAKING: Judges oust Trump ally Alina Habba as New Jersey’s top prosecutor

From PoliticoFederal judges declined to keep President Donald Trump’s former personal attorney as New Jersey’s top federal prosecutor, exercising an arcane statute to rebuff the Trump administration’s wishes.

New Jersey district court judges voted to not let interim U.S. Attorney Alina Habba stay on the job after her 120-day interim term expires, instead picking prosecutor Desiree Leigh Grace, according to a court order posted to the judiciary’s website.

There is confusion about when the change is effective, with the court suggesting Grace’s appointment should begin today, but leaving open it could be another day.

Habba, who served as counselor to the president and as Trump’s personal attorney, was Trump’s pick to be New Jersey’s top federal prosecutor — a position she assumed in March on an interim basis.


Prosecutor Desiree Leigh Grace, who the judges chose to replace Habba, is a registered Republican.

However, Trump had wanted Habba for the role.

Deputy Attorney General Todd Blanche wrote on X, “The district court judges in NJ are trying to force out @USAttyHabba before her term expires at 11:59 p.m. Friday. Their rush reveals what this was always about: a left-wing agenda, not the rule of law. When judges act like activists, they undermine confidence in our justice system. Alina is President Trump’s choice to lead—and no partisan bench can override that.”

Turning Point USA founder Charlie Kirk reacted in outrage. He wrote:

This is ridiculous. Alina Habba was made an interim U.S. attorney back in March. She was formally nominated a month ago. But she hasn’t even received a hearing, let alone the up-or-down vote that a president’s nominees deserve.

There are literally more than 260 federal positions where a Trump nominee is still waiting for a vote. That’s nearly three times the 94 people who have actually been confirmed. Many had their hearings months ago, but have now been kept waiting for a final vote for no reason other than obstructionism and laziness.

This is unacceptable. We have a Republican Senate. We are only guaranteed to hold the White House for a four-year window. The MOST important role of a Republican Senate is to confirm a Republican president’s nominees. Until this administration has its undersecretaries, U.S. attorneys, ambassadors, and judges, it cannot execute the many crucial agenda items it has for making America great again.

Cancel the August recess. Work weekends. Change the rules if you must. But get the nominees confirmed. Period.

Journalist Laura Loomer wrote: “A group of Federal judges appointed by Obama and Biden just declined to extend Alina Habba’s @AlinaHabba term as interim U.S. Attorney of New Jersey following a pressure campaign by @RepJeffries, who attacked Habba for bringing charges against Democrat Rep. @RepLaMonica after she assaulted an ICE agent at an anti-ICE protest earlier this year.”
