From ABC7 Chicago: Hundreds Wednesday have been ordered released on bond after a federal judge weighed the arrests of those detained by federal agents as part of an immigration “blitz” that has shaken the Chicago area.
Those who will be released must be granted bond by noon on Nov. 21. The exact number of those who will be released will depend on how many have not already voluntarily departed or been deported.
The ruling applies to people who have been identified not to have mandatory detention orders and not pose a significant risk.
U.S. District Judge Jeffrey Cummings ordered the Department of Justice to review all remaining arrests through Wednesday that fall under the same category and have a list by Nov. 19, and go from there.
Judge Jeffrey Cummings was nominated by Joe Biden in January 2023.
The order came after a lawsuit was filed by the National Immigration Justice Center and the ACLU, who alleged that more than 3,000 people were arrested between June and October in “Operation Midway Blitz.”
Judge Cummings sided with the plaintiffs, and ordered that 615 of those arrested must be granted bond by noon on Friday, November 21. The judge ordered that the illegal aliens be released on a $1,500 bond, pending the outcome of their immigration proceedings.
Mark Fleming, an attorney with the National Immigrant Justice Center, who led the lawsuit, accused federal agents of violating a 2022 settlement agreement over warrantless arrests in the sanctuary city of Chicago.
Fleming lamented that at least 1,100 of the arrested illegal aliens have already voluntarily left the U.S., instead of staying to fight their cases.
The Department of Homeland Security reacted in fury, writing, “At every turn activist judges, sanctuary politicians, and violent rioters have actively tried to prevent our law enforcement officers from arresting and removing the worst of the worst. Now an ACTIVIST JUDGE is putting the lives of Americans directly at risk by ordering 615 illegal aliens be released into the community.”
