BREAKING: Judge orders planes to return after Trump deports Venezuelan gang suspects under wartime law

From Fox News: Hours after President Donald Trump invoked a wartime law to target terrorist organization Tren de Aragua (TdA) Saturday, a federal judge ruled the law could not be used to deport five Venezuelans and ordered the plane they were believed to be on to return to the U.S.

The Alien Enemies Act of 1798, which allows deportation of natives and citizens of an enemy nation without a hearing, has been invoked three times, during the War of 1812, World War I and World War II.

All Venezuelan citizens 14 years or older who are members of TdA, are within the U.S. and are not naturalized or lawful permanent residents of the U.S. may be apprehended, restrained, secured and removed as “alien enemies,” according to Trump’s proclamation.

Hours before the proclamation was signed, a lawsuit was filed by the American Civil Liberties Union, Democracy Forward and the ACLU of the District of Columbia, claiming it could be used to deport any Venezuelan in the country, regardless of whether they are a member of TdA.

At a hearing Saturday afternoon, Chief U.S. District Judge James Boasberg of the D.C. Circuit granted a temporary restraining order preventing the deportation of the five Venezuelans, who had already been in federal custody for two weeks.

The report notes that the judge ordered two planes believed to already be en route to deport the illegal alien gang members to turn around and bring them back to the United States. As of Saturday night, it was unclear whether the planes had done so.

Judge James Boasberg, 62, was nominated to his position on the D.C. Circuit Court by Barack Obama in June 2010, and was confirmed by the Senate in March 2011. He became the chief judge on March 17, 2023.

The ACLU announced in a statement Saturday morning, “BREAKING: We’re suing the Trump administration over the expected unlawful and unprecedented invocation of the Alien Enemies Act. This is the same policy used during WWII to justify the internment of people of Japanese ancestry.”

“Along with @ACLU and @DemocracyFwd, we’ll see President Trump in court,” the ACLU sneered.

Late Saturday night, the ACLU claimed victory, writing, “UPDATE: A federal judge broadened the scope of an earlier temporary restraining order, blocking Trump from deporting anyone under the Alien Enemies Act while the case proceeds. Flights carrying Venezuelan immigrants the DHS attempted to deport were ordered to turn around.”

Attorney General Pam Bondi blasted the judge’s ruling, saying in a statement, “Tonight, a DC trial judge supported Tren de Aragua terrorists over the safety of Americans. This order disregards well-established authority regarding President Trump’s power, and it puts the public and law enforcement at risk. The Department of Justice is undeterred in its efforts to work with the White House, the Department of Homeland Security, and all of our partners to stop this invasion and Make America Safe Again.”

A hearing is scheduled for Monday.

Angry reactions are pouring in.

Rep. Brandon Gill (R-Tex.) furiously announced, “I’ll be filing Articles of Impeachment against activist judge James Boasberg this week.”

Rep. Chip Roy (R-Tex.) suggested, “Judge Boasberg should be on a plane to Houston to sit with Alexis Nungaray & explain why we must keep TDA gang members who killed her daughter. Radical progressive Dems endangered us by fueling an invasion of our communities. Trump is right to take quick action to reverse it.”

Mollie Hemingway of The Federalist declared, “I’m sorry, but this absolutely lawless order to TURN AROUND PLANES OF TERRORISTS is so insane that I’m having trouble comprehending what Boasberg is possibly thinking. Trump can not possibly agree to this.”

Journalist Kyle Becker wrote, “Another activist judge has ruled that he is the actual President of the United States and not Donald Trump. Chief U.S. District Judge James E. Boasberg has blocked Trump’s plan to deport criminal illegal aliens under the Alien Enemies Act. This judicial activism poses a direct threat to national security and the lives of Americans.”

“A judge just stopped Trump from deporting these murderers, drug dealers, and human traffickers. This radical lawfare is not only out-of-control, it is going to get Americans k*lled,” Becker added.

Sean Davis of The Federalist provided some critical background information:

James Boasberg, the judge who is now lawlessly running interference for literal terrorists, was a member of the corrupt FISA court that rubber-stamped the illegal spy warrants against Trump during the Russiagate hoax.

But that doesn’t begin to show how dirty and corrupt Boasberg is.

Remember Kevin Clinesmith, the FBI attorney who fabricated evidence in those very FISA warrants Boasberg’s court rubber-stamped? Clinesmith was convicted for that crime, but he never served a day in prison.

Do you know why?

Because Boasberg personally sentenced Clinesmith and made sure he never saw the inside of a jail cell, despite Clinesmith’s attempts to overthrow the elected U.S. government via fake evidence and fabricated warrants that Boasberg’s FISA court okayed.

So this conspiracy to provide aid and comfort to criminals and enemies of the United States isn’t Boasberg’s first rodeo. He has a long, sordid history of violating his oath and ignoring the law in his service to America’s enemies. And it’s long past time for him to answer for what he’s done to this country.

Attorney Mike Davis wrote, “Dear Judge Boasberg: You’re ordering the commander-in-chief to return designated foreign terrorists to American soil. Are you out of your fucking mind?”

“Send your law clerks to enforce your lawless and dangerous order. (And do they know how to hijack and fly planes mid-air?)”

Prominent X user RealRobert posted a video of TdA gang members invading an apartment in Aurora, Colorado and wrote:

Federal Judge, James Boasberg, an Obama appointee, the FISA Judge who signed off on the warrants in the Russian Collusion hoax orders the President of the United States carrying two planes full of ‘these folks’ to their hell-hole to return back to the U.S. until the scumbag has more time to consider whether Trump’s use of the Alien Enemies Act was illegal.

“Any plane containing these folks that is going to take off or is in the air needs to be returned to the United States however that is accomplished. Make sure it’s complied with immediately.”

By the way, the lawsuit, brought on behalf of five named Venezuelan criminals was provisionally turned into a class action. Now, the FBI should take him and Amy Coney Barrett into custody for posing as a national security threat.
