BREAKING: Judge blocks Trump’s effort to end multiple Biden-era parole programs

From Fox News: A U.S. federal judge has inflicted another blow to the Trump administration’s efforts to end a multiple Biden-era parole program for hundreds of thousands of migrants from Afghanistan, Latin America and Ukraine.

U.S. District Judge Indira Talwani of Massachusetts on Wednesday ordered the Trump administration to resume processing applications from those migrants who are seeking work permits or renewing their status.

Talwani, an appointee of former President Barack Obama, rejected the Trump administration’s claim that suspending the parole programs was within its broad discretion to direct immigration policy.

Federal law still requires agencies under the U.S. Department of Homeland Security to follow a lengthy process for granting or denying parole and other immigration relief, she wrote in siding with migrants pursuing a class action lawsuit.

Talwani also certified a nationwide class, temporarily protecting all individuals in several humanitarian parole programs while the case proceeds.


ABOUT THIS JUDGE: Indira Talwani, 64, is a United States district judge of the United States District Court for the District of Massachusetts. She was appointed by Barack Obama in September 2013, and confirmed by the U.S. Senate in a 94-0 vote in May 2014. Born in New Jersey, she is the daughter of immigrants from India and Germany.

Law professor Jonathan Turley weighed in, writing on X:

U.S. District Judge Indira Talwani of Massachusetts has enjoined President Trump’s effort to end the “parole” status of hundreds of thousands of immigrants by President Biden. The case can now be appealed, but there is one interesting positive element for the Administration…

…The Court certified a national class action as the basis for the injunction. That is precisely what the Trump Administration argued was the proper way to proceed in these cases. The liberal justices suggested that it is too cumbersome and slow a process…

…Chief Justice Roberts noted that such certification can occur on an expedited basis. Here, the court showed that it can be done as the basis for a national injunction. That is in contrast to individual district judges imposing such universal or national injunctions in cases involving a handful of litigants.

…As we wait for the Court to rule on national injunctions, Roberts now has a case in point on how it is possible for courts to certify national class actions as a foundation for national injunctions.
