From the Associated Press: A state appeals court on Thursday removed Fulton County District Attorney Fani Willis from the Georgia election interference case against Donald Trump and others but did not dismiss the indictment, leaving the future of the prosecution uncertain.

The case against Trump and more than a dozen others had already been largely stalled for months while the Georgia Court of Appeals considered the pretrial appeal.

The new ruling means it will be up to the Prosecuting Attorneys’ Council of Georgia to find another prosecutor to take over the case and to decide whether to continue to pursue it, though that could be delayed if Willis decides to appeal to the state Supreme Court.

Whether it is ultimately Willis or another prosecutor in charge, it seems unlikely that a prosecution against Trump could continue while he’s president for the next four years. But there are 14 other defendants who still face charges.

Willis’ entire case began to crumble when it was revealed earlier this year that she had been in a romantic relationship with special prosecutor Nathan Wade.

Below are some excerpts from the ruling:

“After carefully considering the trial court’s findings in its order, we conclude that it erred by failing to disqualify DA Willis and her office. The remedy crafted by the trial court to prevent an ongoing appearance of impropriety did nothing to address the appearance of impropriety that existed at times when DA Willis was exercising her broad pretrial discretion about who to prosecute and what charges to bring.”

“Accordingly, we reverse the trial court’s denial of the appellants’ motion to disqualify DA Willis and her office. As we conclude that the elected district attorney is wholly disqualified from this case, ‘the assistant district attorneys — whose only power to prosecute a case is derived from the constitutional authority of the district attorney who appointed them — have no authority to proceed.'”

Townhall columnist and legal analyst Phil Holloway shared highlights from the ruling:

BREAKING NEWS 🚨🚨 The Georgia Court of Appeals has disqualified Fulton DA #FaniWillis from the RICO case against @realDonaldTrump.

“We reverse the trial court’s denial of the appellants’ motion to disqualify DA Willis and her office. As we conclude that the elected district attorney is wholly disqualified from this case, “the assistant district attorneys — whose only power to prosecute a case is derived from the constitutional authority of the district attorney who appointed them — have no authority to proceed.”

The indictment is now an “orphan” – an indictment without a prosecutor

The now-infamous “church speech” factored heavily into the “forensic misconduct” piece of all this

Forensic misconduct involves extrajudicial statements by prosecutors against defendants

Court of Appeals notes, correctly, that the “forward looking remedy” of removing only Nathan Wade failed to cure the”

ODOR OF MENDACITY

They remind Willis that the DA has to make decisions “in the public interest”

Here’s the coup de grace:

“disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings”

It’s not just Willis, but the entire DA’s office that is booted.

“Fani Willis DISQUALIFIED – another Trump win!Merry Christmas!!” podcast host Megyn Kelly cheered.

“Fani Willis should be disbarred for abusing her power and weaponizing her office to go after her political enemies,” declared Rep. Marjorie Taylor Greene (R-Ga.).

Amy Kremer, National Committee Woman for Georgia GOP, wrote, “Huge news out of GEORGIA! The GA Coutt of Appeals has ruled and FANI WILLIS and her ENTIRE office has been disqualified from the election-interference case against Trump and his co-defendants. Merry Christmas!!!!”

Will Chamberlain announced, “The Georgia Court of Appeals just ruled that Fani Willis must be disqualified from the 2020 election case – along with her entire office. Very likely the death knell of the entire case. They’d need to find another county willing to take it on.”
