BREAKING: Appeals court rules on Trump’s attempt to overturn E. Jean Carroll verdict

From ABC News: A federal appeals court on Monday rejected President-elect Donald Trump’s attempt to overturn a jury’s verdict last year that found he sexually abused writer E. Jean Carroll in the mid-1990s.

The Second U.S. Circuit Court of Appeals decided “Trump has not demonstrated that the district court erred in any of the challenged rulings” and “has not carried his burden to show that any claimed error or combination of claimed errors affected his substantial rights as required to warrant a new trial.”

The jury in the civil case held Trump liable for sexually abusing Carroll in a dressing room at a Bergdorf Goodman department store in Manhattan in the mid-1990s, and determined that, in 2022, he made defamatory statements about her. The jury awarded Carroll $5 million in damages.

A different jury, in a separate civil trial, ordered Trump to pay Carroll, a former Elle magazine columnist, $83 million in damages. Trump’s appeal of that verdict is pending.


Monday’s decision was made by a three-judge panel on the U.S. Court of Appeals for the Second Circuit.

The Hill noted that Trump “could now ask the full appeals court to review Monday’s ruling or bring the case to the Supreme Court.”

Trump has emphatically denied Carroll’s allegations.  He has slammed District Court Judge Lewis Kaplan for allowing two other women to testify during Carroll’s trial of their allegations that Trump sexually assaulted them – allegations he has also denied.

Kaplan also allowed part of the infamous “Access Hollywood” tape to be brought as ‘evidence’ during Carroll’s trial. In Monday’s opinion, the appeals court claimed the tape was admissible “as evidence of a pattern” of Trump’s alleged behavior.

However, during the same trial, Trump’s legal team was not allowed to use evidence found in Carroll’s social media to show a pattern of her behavior, as her posts showed a bizarre obsession with sex.

Citizen journalist Charles Downs posted an old video of Carroll in a CNN interview, and wrote, “It’s pretty wild how E. Jean Carroll can go on Anderson Cooper’s show and say “rape is sexy” and somehow Trump is still the “bad guy.” What’s wrong with these Democrat run courts?”

LinkedIn founder and Democrat Reid Hoffman reportedly provided critical legal funding for Carroll’s sexual assault lawsuit against Trump.
