From the Associated Press: A federal appeals court ruled Wednesday that President Donald Trump’s order seeking to end birthright citizenship is unconstitutional, affirming a lower-court decision that blocked its enforcement nationwide.
The ruling from a divided panel of the 9th U.S. Circuit Court of Appeals comes after Trump’s plan was also blocked by a federal judge in New Hampshire. It brings the issue one step closer to coming back quickly before the Supreme Court.
The 9th Circuit blocks the Trump administration from enforcing the order that would deny citizenship to children born to people who are in the United States illegally or temporarily.
The Appeals Court ruling states, “We conclude that the Executive Order is invalid because it contradicts the plain language of the Fourteenth Amendment’s grant of citizenship to “all persons born in the United States and subject to the jurisdiction thereof.”

Washington State Attorney General Nick Brown, a Democrat, cheered, “The Ninth Circuit affirms our nationwide injunction in birthright citizenship. The court agrees that the president cannot redefine what it means to be American with the stroke of a pen. He cannot strip away the rights, liberties, and protections of children born in our country. This lawsuit was the first case I brought as Attorney General, and I am proud that courts at every level agree with us. – NB”

Arizona state attorney general Kris Mayes, also a Democrat, touted the ruling, writing, “The US Court of Appeals in the 9th Circuit has once again blocked Trump’s attempt to repeal birthright citizenship in the case we joined in January. No president can change the constitution with the stroke of a pen.”

Earlier on Wednesday, Rep. Claudia Tenney (R-NY) introduced a bill to end automatic birthright citizenship for children of illegal aliens.
“Birthright citizenship was never meant to be a reward for breaking our immigration laws. The Constitutional Citizenship Clarification Act makes it clear: No citizenship for children born to illegal aliens, foreign spies, or terrorists,” Tenney declared.
