From Breitbart: President Donald Trump’s transportation secretary has issued new regulations to remove almost 200,000 dangerous migrant truck drivers from the nation’s highways.
“The combination of a catastrophic failure of states to follow the law and a broken system has created an imminent hazard to American travelers,” Transportation Secretary Sean Duffy said on Friday morning as he announced emergency rules to exclude dangerous foreign drivers and to penalize California’s pattern of “illegally” awarding licenses to foreign drivers.
The new rules are limited by threatened lawsuits from major trucking companies, warehouses, and retailers such as Amazon. For example, the roughly 190,000 foreign drivers will be able to operate until their licenses expire. This delay gives transport companies time to hire and train Americans, perhaps at decent wages.
The Duffy regulations are good news for American truckers who are facing wage-cutting competition from the many foreign drivers welcomed by President Joe Biden. For example, Biden’s deputies allowed many young Indian men to enter the country on B-1/B-2 tourist visas, knowing they were likely to get a Commercial Driver’s License (CDL) in Democrat-run, migrant-friendly licensing offices.
President Trump signed an executive order in April requiring all commercial truck drivers to be able to speak and understand English.
A press release by the Department of Transportation states:
The audit has uncovered both a catastrophic pattern of states issuing licenses illegally to foreign drivers, as well as the fact that even if the current regulatory framework is followed, it can fail. The confluence of these two factors has created an imminent hazard on America’s roadways that must be fixed.
Moving forward, non-citizens will not be eligible for a non-domiciled CDL unless they meet a much stricter set of rules, including an employment-based visa and undergoing a mandatory federal immigration status check using the SAVE system.

The Transportation Department is especially cracking down on the State of California. The press release states:
In California alone, more than 25% of non-domiciled CDLs reviewed were improperly issued. This opens the door to thousands of unsafe drivers on the road, including some with licenses extending as many as four years beyond the expiration date of their lawful presence documentation. In one shocking case, California gave a driver from Brazil a CDL with endorsements to drive a passenger bus and a school bus that was valid for months after his legal presence expired.
This is why, in addition to the emergency rule, Secretary Duffy also announced direct enforcement action against California. The state must immediately:
- Pause issuance of non-domiciled CDLs.
- Identify all unexpired non-domiciled CDLs that fail to comply with FMCSA regulations.
- Revoke and reissue all noncompliant non-domiciled CDLs if they comply with the new federal requirements.
“California has 30 days to come into compliance, or FMCSA will withhold federal highway funds — starting at nearly $160 million in the first year and doubling in year two,” the announcement reads.
The DOT revealed there have been at least five fatal crashes since January involving non-citizen commercial truck drivers.
A video currently going viral on social media is of a deadly crash that happened in June 2023 in New Mexico. The driver was allegedly from China and had obtained a Commercial Driver’s License (CDL) in California despite speaking only Mandarin.

On Friday, Duffy announced: “Today I announced two major actions to protect American roadways: 1) @USDOT is immediately tightening restrictions for non-citizen commercial driver’s licenses. 2) All states must pause new non-citizen driver’s licensing until they meet federal safety standards. Our message is simple: get into compliance NOW or lose federal funding.”
