From the Washington Examiner: A federal appeals court judge quietly dismissed a judicial misconduct complaint the Justice Department filed against U.S. District Judge James Boasberg, dealing a setback to the Trump administration’s effort to challenge one of its most prominent judicial critics in the fight over deportations to El Salvador.
The complaint was rejected on Dec. 19, 2025, by Jeffrey Sutton, the chief judge of the U.S. Court of Appeals for the 6th Circuit, although the order did not become public until this weekend. Sutton concluded that the DOJ failed to back up its allegations with evidence and fell well short of the standard required for a misconduct finding, according to a seven-page decision.
The complaint centered on James Boasberg, the chief judge of the federal district court in Washington, D.C., who repeatedly clashed with President Donald Trump’s administration last year over its use of the Alien Enemies Act to deport Venezuelan migrants to a high-security prison in El Salvador.

However, the report notes that the Justice Department failed to provide the evidence. In their complaint, the DOJ referenced an attachment to back up their allegations against Boasberg, but allegedly, no attachment was included and the DOJ did not provide it, even after being contacted by the court.
Since the evidence was missing, the complaint was tossed.

This is completely unforgivable. Back in July, with great fanfare, the DOJ filed a complaint against “Judge” Boasberg. The complaint has now been dismissed because DOJ failed to attach the supporting evidence.
The core of the complaint was @ProfMJCleveland’s exclusive reporting in The Federalist, which showed Boasberg revealing his entrenched and undisguised anti Trump bias while advising other judges. Specifically, Boasberg privately speculated about the Trump administration allegedly disregarding court rulings, a comment that was both improper and prejudicial.
There is no excuse for the DOJ failing to include the memo in which Boasberg is documented making his statements. That memo was the entire point of the complaint. Without it, the filing was dead on arrival. Even worse, the dismissal reveals that instead of attaching the actual evidence, the DOJ cited a Fox News *clip*. Total amateur hour and borderline farcical.
Frankly, a complaint of this magnitude collapsing over basic evidentiary failures smells more like intent than mere incompetence.

On July 28 of last year, AG Bondi had announced, “Today at my direction, @TheJusticeDept filed a misconduct complaint against U.S. District Court Chief Judge James Boasberg for making improper public comments about President Trump and his Administration. These comments have undermined the integrity of the judiciary, and we will not stand for that.”
