DANGEROUS PATH: Trump administration fires back after California tries to block troops

From NBC NewsThe Trump administration formally responded to California’s legal bid to block the military from getting involved in immigration enforcement, calling the state’s lawsuit a “crass political stunt” that is “endangering American lives.”

The president “has every right under the Constitution and by statute to call forth the National Guard and Marines to quell lawless violence directed against enforcement of federal law,” the Justice Department’s filing said.

The filing argues that “instead of working to bring order to Los Angeles,” Newsom sued seeking a court order “limiting the federal government’s ability to protect its property and officials.”


The DOJ filing is a response to a temporary restraining order issued by Newsom and California Attorney General Rob Bonta’s to bar the National Guard troops and Marines from participating in immigration enforcement activities. It is not intended to prevent forces “from protecting the safety of federal buildings” or “federal personnel on such property,” but clarifies that it’s unlawful for them to be a part of law enforcement activities.

The Justice Department filing confirms that the National Guard and the Marines are not engaged in law enforcement.

“Rather, they are protecting law enforcement, consistent with longstanding practice and the inherent protective power to provide for the safety of federal property and personnel,” the filing states.

A judge will hear arguments on the state’s request tomorrow.

Meanwhile, the White House has confirmed that Trump has no problem with peaceful protests.

White House press secretary Karoline Leavitt told reporters, “The president absolutely supports peaceful protests.”

She said Trump “does not support violence of any kind,” however.

Asked if Trump would tolerate protests on Saturday during the military parade in downtown Washington, D.C., Leavitt said, “of course” he would be fine with them.

“What a stupid question,” she added.
