From Reuters: A group of Democratic state attorneys general on Thursday filed a lawsuit seeking to block Republican U.S. President Donald Trump’s administration from dismantling the U.S. Department of Education and halt it from laying off nearly half of its staff.
Democratic attorneys general from 20 states and the District of Columbia filed the lawsuit in federal court in Boston after the Education Department on Tuesday announced plans to lay off more than 1,300 of its employees as part of the agency’s “final mission.”
Trump has vowed to eliminate the department, which oversees $1.6 trillion in college loans, enforces civil rights laws in schools and provides federal funding for needy districts. The job cuts if implemented would leave the department with 2,183 workers, down from 4,133 when Trump took office in January.
The lawsuit argues that the massive job cuts are an effective dismantling of the department and will incapacitate components of the agency responsible for performing functions mandated by statute, “effectively nullifying those mandates.”
The lawsuit was filed in federal district court in Massachusetts.
Democrat-led states involved in the lawsuit include: Arizona, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New York, Oregon, Rhode Island, Washington, Wisconsin, Vermont and the District of Columbia.
New York Attorney General Letitia James proudly announced her role in the lawsuit, in her latest attack against the Trump administration.
“My office and a group of AGs are suing to stop Trump’s illegal attempt to dismantle the U.S. Department of Education. We’re not going to sit by while this administration attempts to leave tens of millions of students behind and strip away their access to a quality education,” James wrote.

New York Gov. Kathy Hochul, also a Democrat, jumped on board as well, writing, “If you go after New York kids, get ready for a fight. Proud to join @NewYorkStateAG and our colleagues across the nation to stand up to this outrageous abuse of power.”

California Attorney General Rob Bonta, another radical Democrat, announced, “We’ve filed a lawsuit challenging the unlawful mass firing of nearly half of all employees at the U.S. Dept of Education. Gutting @USEDGOV from within would have catastrophic consequences for our nation’s students. We’re going to court to protect them.”
