A House Judiciary Committee report reveals that the Biden-Harris administration has enacted a “quiet amnesty” by closing nearly a million illegal immigration cases.

The report also shows that over 3.7 million new cases have been added to the immigration court backlog since Fiscal Year 2021, with 1.5 million in the first three quarters of Fiscal Year 2024 alone.

The report claims the Biden-Harris administration has used the immigration court backlog to permit more migrants to stay in the U.S. Instead of reviewing cases on their merits, and immigration judges are allegedly directed to dismiss, close, or terminate cases, allowing migrants to remain without consequences. This “quiet amnesty” has reportedly become standard practice in the administration’s immigration courts.

The report reveals nearly a million migrants have benefited from the Biden-Harris “quiet amnesty,” with their immigration cases dismissed, terminated, or administratively closed, allowing indefinite U.S. stays. In comparison, from Fiscal Year 2017 to 2020, fewer than 13,000 asylum cases went unadjudicated. By Fiscal Year 2024, that number had surged to over 109,500 cases.

The report indicates that under Biden and Harris, DHS has neglected to prosecute over 200,000 cases, issuing Notices to Appear—the start of removal proceedings—in only a tiny portion. Consequently, the majority of these migrants are likely to remain in the U.S. indefinitely.

The report reveals that only 14 percent of asylum applicants were granted asylum, while 86 percent had their cases denied or closed. Since taking office, the Biden-Harris administration has admitted nearly 8 million migrants through various channels.
